These Terms of Use ("Terms") are an agreement between you and Speaktacular, LLC ("we", "us"), the operator of the Promotion Prep app and the promotionprep.com website. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.
Promotion Prep is a self-study aid for Airmen preparing for enlisted promotion exams, based on the public Air Force Handbook 1. It is a study tool, not the test itself. The app can be used without paying: the free tier includes sample content and practice. Full access unlocks the complete study content, and it is sold as a one-time lifetime access purchase on our website. "Lifetime" means the lifetime of the product, not of the buyer: if we ever retire the app, access ends when the service closes. Nothing about full access expires on a recurring basis, and there is no subscription to cancel.
Full access is tied to the account that bought it, and restoring it is automatic: sign back into the same account - on the website or in the iOS or Android app - and your access is there. If you bought with a different email address than the one you usually sign in with, that first account is the one holding the access, and support@promotionprep.com can help you sort out which is which.
Deleting your account removes your study data from the app at once and removes the link between your account and its purchase. Deleted records are held in the platform's recently-deleted area for about 30 days, restorable only by the app owner, before permanent removal. If you need help with a purchase after deleting your account, contact us at support@promotionprep.com.
The app is an independent commercial product. It is not affiliated with, endorsed by, or sponsored by the United States Air Force, the Department of Defense, or any other government agency. Official Air Force publications and guidance always control. All practice questions and situational judgment scenarios in the app are written for this app and are not official Air Force exam questions. We work to keep study content accurate and current, but exam material changes and we do not promise that the app reflects the most recent testing cycle at every moment.
The app is a study aid, nothing more. We do not guarantee any exam score, promotion outcome, or career result. Nothing in the app is legal, financial, career, or professional advice, and using it does not create any professional relationship with us.
You must be at least 13 years old to use the app. Provide accurate information when you sign up, keep your sign-in credentials to yourself, and tell us at support@promotionprep.com if you suspect someone else is using your account. You are responsible for activity under your account. One account per person; do not share accounts.
Full access is a one-time purchase, not a subscription, and it is bought on our website. The current price is always shown on the checkout page before you pay, in US dollars. Prices may change for future buyers, but a purchase you have already made will not be charged again. Card details are handled entirely by our payment provider and never reach us. When a purchase is made through the Apple App Store or Google Play, that store processes billing and supplies the transaction and purchase-status records, card details are handled by that provider, and that provider's own terms also apply to the purchase.
Full access is digital content made available immediately. For help with your account, purchase, or study content, contact support@promotionprep.com. A purchase made on our website is processed by our payment provider, and we will look at any refund request on its facts rather than hiding behind the fact that the content was delivered. Nothing in these Terms removes or limits any refund or cancellation right you have under the law that applies to you.
We give you a personal, non-exclusive, non-transferable license to use the app for your own study. You agree not to copy, resell, redistribute, or publicly post the app's questions or content; not to scrape or bulk-download it; not to reverse engineer it except where the law allows; and not to use it for anything unlawful.
The app, its study content, and its design are owned by us or our licensors and are protected by copyright and other laws. These Terms give you no ownership of any of it.
The app runs on Base44 (hosting, sign-in, and the "Explain this" AI feature). Where you use them: Google, if you sign in with Google in a browser rather than with an email and a password; Stripe, for purchases made on our website; the store that billed a purchase made in the iOS or Android app - the Apple App Store or Google Play; and the native app wrapper that connects the mobile app to your device. Your use of those services is also subject to their own terms and policies, which we do not control.
The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that study content will match the current exam.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us, or $50 if you have not made a purchase. Some states do not allow certain limits, so parts of this section may not apply to you.
If your misuse of the app or breach of these Terms leads to a claim against us, you agree to cover our reasonable costs and damages arising from that claim.
You can stop using the app and delete your account at any time. We may suspend or end accounts that break these Terms. The sections on intellectual property, disclaimers, liability, and governing law survive termination.
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Oklahoma, and you and we consent to their jurisdiction.
We may update these Terms from time to time. We will post the new version at the same address and update the date shown at the top. If a change is significant, we will note it in the app. Continuing to use the app after a change means you accept the updated Terms.
